by Indeewara Thilakarathne The Colombo High Court on Tuesday convicted two brothers accused of attempted murder and robbery. In this connection Atukoralage Nihal Perera and Atukoralage Sumathi Nanda Perera the two brothers were charged with attempted murder of Walisarage Samanmal Fernando on or about August 24, 1992 and the robbery of Rupees 293,041 and five cents. Defence Counsel Cyril Wijekoon in mitigation stated that there were no previous convictions against the second accused Atukoralage Sumathi Nanda Perera and said that he was a youth of 24 years. The State Counsel citing section 300 and 380 of the Penal Code urged the Court that the accused should be strictly dealt with to deter others from committing such offences in the future. He said that the injured Samanmal Fernando had narrowly escaped death by the act of shooting with a fire arm. The accused had also committed day light robbery. He called for finger print report of the first accused Atukoralage Nihal Perera. Accordingly, Court called for the finger print report of the first accused and the sentence was put off for March 19, 2002. Mr. Cyril Wijekoon appeared for the accused while State Counsel Nawarathne Marasinghe appeared for the prosecution. |
