by Wasantha Ramanayake Colombo District Judge, Rohini Walgama issued an enjoining order restraining the putting up of illegal structures in a land around Parliament and the Diyawanna Oya area claimed to be acquired by the Sri Lanka Land Reclamation and Development Corporation for the Greater Colombo Flood Control and Environment Improvement Project. The order restrained the defendant, B.A. Poojitha of Vishaka Road, Colombo 4 from filling or putting up of illegal structures in the said land. The order was a sequel to an application by plaintiff Sri Lanka Land Development and Reclamation Corporation. Plaintiff's Counsel, Bhaddra de Silva submitted that the Government and the Japanese Overseas Economic Co-operation Fund (JOECF) entered into an agreement to fund the said project. Under the project the said area was reserved for the purpose of flood retention. Counsel submitted that the defendant had filled the section of the said land and had put up certain structures. Further, the plaintiff had reliably learnt that defendant was in the process of demarcating it and selling the plots of land for a housing scheme. The Plaintiff had lodged a complaint at the Rajagiriya Police in this connection. She further submitted that if the illegal activities of the defendant was continued, the aims of the said flood control project could not be achieved. Further, the monies spent on the whole project both by the Government and the JOECF would be rendered useless and the project would loose further grants under the said agreement. Bhaddra de Silva Instructed by Anusha Nawaratne appeared for the plaintiff. The case was put off for October 10. |
