NOTICE ISSUED ON EX-CJ
* Should appear before SC on March 5
* Intervenient petitioner wants Court of Appeal rulings quashed

A three Judge Bench of the Supreme Court yesterday issued notice on
former Chief Justice Shirani Bandaranayake returnable on March 5.
The Bench comprised Justice Shirani Thilakawardana, Justice Chandra
Ekanayake and Justice Sathya Hettige.
The court issued notice on the respondent sequel to an application
filed earlier by Attorney at Law Susmudu Kantha Hewage challenging a
Court of Appeal ruling quashing the decision of the Parliamentary Select
Committee (PSC) which found the former Chief Justice guilty of
misconduct. Besides, the petitioner moved the court to set aside the
Court of Appeal decision refusing to consider him as an intervenient
petitioner in the same matter.
He also moved court to set aside the Court of Appeal decision not to
allow the intervening petition filed by him praying for the setting
aside or reversing the Court of Appeal ruling to issue a Writ of
certiorari to quash the PSC findings.
