White Flag bail application:
Court sets May 9 to decide on three issues

The Supreme Court yesterday fixed May 9 for a decision on three
issues in respect of the White Flag Case bail application.
The matters to be taken up are as follows:
*An application filed by Attorney-at-Law Nalin Laduwahetty in respect
of the continuation of treatment of Sarath Fonseka at the at the
Nawaloka Hospital on humanitarian grounds.
*To decide on the date to file the bail application of Sarath Fonseka
either at the High Court of Supreme Court.
*To fix a date for the appointment of a reconstituted five member
Bench.
The Bench comprised of Chief Justice Shirani Bandaranayake, Justice
Sri Pavan and Justice Priyasath Dep.
At the outset, the Bench observed that some of the five member Bench
had gone on vacation. Hence there was a need to reconstitute a new
Bench.
The counsel submitted that Sarath Fonseka as the former Army
Commander had thrice sustained injuries in the war against the LTTE.
Some pellets are still inside his body.
As the Welikada Prison, where he is presently serving a three year
jail term upon being found guilty in the 'White Flag ' case is dusty, he
should be refereed to Dr. Vajira Tennakoon at the Nawaloka Hospital for
treatment.
Deputy Solicitor General Palitha Fernando did not object to the
application saying that, however, he has no documents in this
connection.
The Bench directed such documents to be handed over at the next
hearing.
