Court refuses bail application

Colombo High Court Judge Deepali Wijesundera yesterday refused an
application for bail in respect of Capt. Senaka Harippriya de Silva and
remanded him till May 3, 2011.
In this case Sarath Fonseka is charged with having employed about ten
soldiers who were deserters for his election campaign. Capt. Senaka de
Silva is alleged to have assisted Sarath Fonseka to employ the deserters
for the election campaign. Capt. Senaka de Silva was the election
secretary for Sarath Fonseka during the election period. On an
application by ULG Bandara, Counsel for Sarath Fonseka, Judge
Wijesundera directed the Prison authorities to provide hot water and
other facilities to Sarath Fonseka who is sick, according to his
counsel.
Senior State Counsel Dammith Totawatta appeared with the CID for the
prosecution vehemently objected to the accused being granted bail and
said that he had not given correct facts in his affidavits to court. He
had also not told the truth to his lawyers about his position in the
Army. Senior Attorney Saliya Peiris who appeared for Capt. Senaka de
Silva with Roshan Nanayakkara moving for bail said that their client's
business also had been hampered due to being in remand custody for
several months. U.L.G. Bandara with Manjula Pathiraja, Mervey Silva,
Bandara Ekanayake, Anuradha Liyanage and Chathura Anushka Amarasinghe
instructed by Paul Ratnayake Associate appeared for Sarath Fonseka.
The case will be called again on May 3.
