Mandatory English tests for aspirant UK settlers

The UK Government announced the introduction of compulsory English
language tests for spouses and partners of UK citizens or permanent
residents who apply for visas to settle in the UK.
This immigration rule will be applicable for all Sri Lankans and all
other non-European Economic Area nationals, a spokesman for the British
High Commission in Sri Lanka told the Daily News.
From Autumn 2010, spouses and partners who come to the UK from
outside the European Economic Area will have to demonstrate a basic
command of English that allows them to cope with everyday life before
they make their visa application.
The rules are intended to help migrants integrate into British
society to open up more opportunities, help prevent exploitation and
allow them to benefit from and contribute more to their communities.
This English language requirement will not apply to spouses and
partners of migrants in the UK on temporary visas such as students or
workers under the Points Based System. It will only apply to those
intending to settle.
Spouses and partners will have to demonstrate basic English at A1
level Common European Framework of Reference (CEFR). This is the same
level required for skilled workers admitted under the skilled Tier 2 of
the Points Based System. It requires learners to demonstrate a basic
command of conversational English.
Someone assessed at level A1 can understand and use familiar everyday
expressions and very basic phrases.
It will be necessary to use one of the UK Border Agency’s approved
test providers and submit evidence of the qualification when applying
for the visa.
It will affect non-European Economic Area nationals applying to come
to, or stay in the UK as a spouse or civil partner; fiancé or proposed
civil partner; and unmarried partner or same sex partner of a British
citizen or permanent resident.
The language test will be compulsory for settlement and fiancé visa
applicants overseas, as well as people applying within the UK.
The spokesman further said, the date of implementation of this rule
will be announced soon, together with details of acceptable
qualifications and test providers. |
