Finance companies have no legal rights to seize vehicles

Nugegoda Magistrate Wasantha Jinadasa directed the Mirihana Special
Crime Division to conduct investigations into a complaint made by N.M.C.
Amarasekera of Maharagama and produce the suspects, who were involved in
an attack on Amarasekera, removing his gold jewellery and his Benz car
valued at over Rs. 2 million before court.
Earlier, the Maharagama Police filing a 'B' report before the
Nugegoda Magistrate stated that several persons unlawfully entered the
house of Amarasekera and had broken open the door attacked Amarasekera
with a firearm and removed his gold chain and his Benz car bearing
number W.P.H.E. 7676.
The Finance Companies have no legal rights to seize vehicles which
had not paid their instalments, in an unlawful manner.
On an application by the Finance Company the Magistrate released the
vehicle in question to the Finance company on a bond of Rs.200,000 and
directed them to assist in the investigations conduct by the Mirihana
Special Crime Division.
The Magistrate said that the vehicle should be produced before the
Mirihana Special Crime Division as an when required by the
investigators.
