Attorney acquitted

The Avissawella High Court Judge Aruna C. Ranasinghe acquitted Senior Attorney at Law Premalal Wickremaratne found not guilty to the charges preferred against him under Section 403 of the Penal Code.

The Senior Attorney was charged with cheating under section 403 of the Penal Code for fraudulently getting a deed of transfer executed on the pretext of executing a deed of mortgage.

The Judge in his lengthy judgement stated that prosecution had failed to establish the most essential ingredient of cheating namely intention on the part of the accused in this transaction.

This case had not been proved beyond reasonable doubt, the Judge observed. Earlier Senior Defence Counsel Upali Senaratne submitted to Court that the prosecution woefully failed to establish the case beyond reasonable doubt and highlighted all the contradictions, omissions and other imperfections which went to the very core of the Prosecution case.

Senior Counsel Upali Senaratne with Seevali Amithirigala instructed by Nadeeka Kalubowila appeared for the defence.
