Counsel objects to
release suspect's passport
Criminal Breach of trust of Rs. 60 million

COLOMBO: The Criminal Investigation Department (CID) probing the
alleged criminal breach of trust of Rs. 60 million, belonging to
business tycoon Sabir Hussein told Colombo Fort Magistrate and
Additional District Judge Namal Balalla that investigations into the
complaint was not completed.
Hemantha Warnakulasuriya, Senior Counsel for the suspect Sabrina
Fahim of Kollupitiya, moved court to lay-by the case as there could be a
settlement among the complainant and the suspect.
The suspect is the sister of the complainant. Counsel Warnakulasuriya
also moved court to release his client's passport to go abroad for a
short period.
President's Counsel M.L.M. Ameen who appeared with Deemani Baddewela
for the complainant Hussein objected to the suspect's passport being
released and said that the CID have not completed the investigation into
the criminal breach of trust of large sums of money belonged his client
Hussein.
At this stage the Judge observed that there is an order from the High
Court not to release passports to suspects from this court.
On an application by Warnakulasuriya the Judge put off the case for
March 15 and directed the Senior Defence Counsel to make the submissions
regarding the release of the passport on that day.
The Judge also directed the CID to submit a comprehensive report in
connection with their investigations on the next date.
President's Counsel M.L.M. Ameen with Ms. Deemani Baddewela appeared
for the complainant with the CID. Hemantha Warnakulasuriya with Shiraz
Noordeen appeared for the suspect.
The case will be called again on March 15, 2006. |
