EPDP election petition dismissed

by Wasantha Ramanayake

The Court of Appeal yesterday dismissed an Election Petition filed by an EPDP candidate challenging the election of two TNA candidates for the Trincomalee district.

The court dismissed the application on the basis that the application was filed after the stipulated time. The court ordered to pay Rs. 35,000 as cost.

Petitioner Dr. K. Vigneswaran cited A. Sambanthan and K. Thurairajasingham MPs for the Tamil National Alliance and several others as respondents.

President's Counsel K. Kanag Ishwaran for the respondents raised objections that the application was out of time, it had not been signed by the petitioner. Petitioner stated that he was a candidate for the Trincomalee District and complained to court that the General Election held in connection with the Trincomalee district was not fair. He alleged that the LTTE engaged in election malpractices and that the LTTE illegally forced the people of the district to vote for the ITAK. The LTTE engaged in this exercise months prior to the General Election that was held in April 2. They also alleged that the LTTE provided transport facilities, food and lodging for voters on the election day in violation of Election Rules.

Chinthake Siriwardane appeared for the petitioner.

President's Counsel K. Kanag Ishwaran appeared for the respondents.
