Ratnasiri files special leave to appeal

Former Prime Minister Ratnasiri Wickremanayake yesterday filed special leave to appeal an application in the Supreme Court seeking the dismissal of the application filed in the Court of Appeal challenging the appointment of UPFA MPs on the national list.

The petitioner has cited lecturer Rohan Edirisinghe, Commissioner of Elections, UPFA General Secretary Susil Premajayantha, UNP General Secretary Senarath Kapukotuwa, Anuruddha Ratwatte, the ITAK and two others as respondents.

The petitioner stated that he is the former Prime Minister of the People's Alliance Government which came to power in April 2, 2004 and the PA secured 13 seats on the National List. Wickremanayake submitted that Janadasa Peris was appointed a National List MP and after his resignation from the post, he was appointed on behalf of Peris.

Meanwhile, Edirisinghe and several others had filed a writ application in the Court of Appeal challenging this appointment.

Wickremanayake stated that the Court of Appeal delivered the order on July 7 that it has jurisdiction to hear and determine the application. Being aggrieved by this order, the petitioner stated that the sole and exclusive jurisdiction in hearing matters pertaining to elections is vested with the Supreme Court.

Wickremanayake prayed that the Court of Appeal Order be set aside. He prayed to dismiss the application and issue an Interim Order staying the proceedings of the application in the Court of Appeal.

Sanath Wijewardana filed the application.
