CID OIC restrained from arresting former commissioner of Registration of Persons by Indeewara Thilakarathne The Court of Appeal yesterday issued a Stay Order restraining the 1st respondent, OIC Gang Robbery Branch of the CID from arresting the former Commissioner of Registration of Persons K. J. V. Ranasinghe. The Court also issued notice on the 1st respondent returnable on August 26, 2004. The Order was sequel to a revision application filed by Ranasinghe against the Magistrate Order that rejected granting anticipatory bail to the petitioner. The Bench comprised President of Court of Appeal Saleem Marsook and Justice L.K. Wimalachandra. In this application, Ranasinghe has cited OIC Gang Robbery Branch of the CID and the Attorney General as respondents. Ranasinghe stated that he had been transferred to Public Administration Pool on August 2, 2004. On July 21, 2004 the petitioner came to know through newspapers that he was to be arrested with regard to issuing Identity Cards to persons on forged documents. The petitioner stated that he had submitted anticipatory bail application to Colombo Magistrate Courts on August 2,2004 and the application was rejected by the Colombo Chief Magistrate on August 7, 2004. The petitioner prayed that Order be issued restraining the 1st respondent from arresting him and also to set aside the Order made by the Colombo Magistrate. The petitioner prayed that he be granted anticipatory bail. D.P. Kumarasinghe PC with Ganesh Dharmawardana instructed by Chandika Peiris appeared for the petitioner. |
