AG to seek instructions from Secretary, Defence

The Attorney General would seek instructions from the Secretary to the Ministry of Defence as to whether the displaced person from Tellipallai area in Jaffna could be facilitated to repair his house and cultivate his land, submitted a Senior State Counsel before the Supreme Court on Monday.

This was a sequel to a submission by the K. Kanag Ishwaran, PC Counsel for the petitioner Sinnappu Sivagnanasambanthar, Pannala, Thellippallai. The Bench comprised Chief Justice Sarath N. Silva, PC and Justices Asoka de Silva and N.K. Udalagama.

The Counsel for the petitioner submitted that the area had been cleared of landmines and his client was willing to cultivate the land. He further submitted that many persons had already repaired their houses and were in occupation. The counsel undertook to appraise the AG of the situation in writing.

The petitioner stated that the group of Army personnel had stopped him from clearing the land that belonged to him after ten years violating his Fundamental Rights. The petitioner, a farmer, stated that his family was compelled to move out of their houses in the Jaffna District due to military operations in 1992. Thereafter, they had been living as internally displaced persons. He claimed that his family had been depending on dry rations worth of Rs. 1008 per month.

Meanwhile, the court fixed for support two similar applications filed by Jaffna District MP. M.S. Senadhirajah, and another resident Vallipuran Rajadurai of Malaivempady, Alaveddy.

Parliamentarian Senadhirajah stated that his rights were violated by the respondents when the occupation of the house that belonged to his wife in Kilanai, Kollankallady was denied on the basis that it was allegedly located within the High Security Zone. He alleged that the area was not gazetted as a High Security Area and therefore the denial to occupy the land was in violation of his rights.

Senior State Counsel S. Rajaratnam appeared for the respondents.

The cases are to be mentioned on July 26.
