by Wasantha Ramanayake A State Counsel undertook before the Supreme Court to obtain further instructions as to whether a 53-year-old teacher transferred allegedly in contravention to the Establishment Code and the National Teacher Transfer Policy could be transferred back to a school convenient to him. The Bench comprised Chief Justice Sarath N. Silva PC, Justices H. S. Yapa and Nihal Jayasinghe. Counsel Ayanthi Abeywickrama for petitioner Mohideen Abdul Gaffoor of Vajirapura, Nuwara Eliya, submitted that the client was willing to serve at St. Xavier's College, Nuwara Eliya. Accordingly, State Counsel M. Gopallawa undertook to look into the possibility to effect the transfer. The petitioner stated that he had 25 years of teaching experience and he was teaching at Holy Trinity Central College when he was transferred to the Nanu Oya Tamil Maha Vidyalaya on July 11, 2003. The petitioner alleged since he was over 53 years, his transfer was in contravention to the National Teacher Transfer Policy and the Establishment Code. He stated that his transfer was not even approved by the Zonal Teacher Transfer Board in terms of the National Teacher Transfer Policy. The petitioner stated that the transfer was in violation of his rights and sought to cancel the transfer. He cited Central Provincial Education Ministry Secretary Vijitha Bandara, Zonal Education Director Nuwara Eliya, G. G. L. G. Perera, Additional Zonal Director and the Attorney General as respondents. The case will be mentioned on June 28, to ascertain the possibility of effecting it. |
