by Indeewara Thilakarathne The Court of Appeal Judge Justice Gamini Ameratunga yesterday directed the Registrar of the Court of Appeal to appoint a fresh Bench sans himself as a member to hear and determine the bail application filed by the Chairman Sri Lanka Telecom, Thilanga Sumathipala. The directive was sequel to an application made by the Counsel for the petitioner, D. S. Wijesinghe PC that his client, the petitioner, did not wish to hear his bail application before a Bench comprising Justice Gamini Ameratunga. "I have no intention of hearing a case when a litigant does not wish me to be a member of that Bench. Justice should not only be done but also appear to be done", observed Justice Ameratunga in delivering the directive. Earlier, the Order on the question of Jurisdiction whether the Court could entertain this application was fixed for yesterday. However, when proceedings commenced Justice Gamini Ameratunga informed Court that the Order was not ready. The Bench comprised Justices Nimal Ameratunga and L. K. Wimalachandra. D. S, Wijesinghe PC with D. P. Kumarasinghe PC, Denzil Gunaratne, Kolitha Darmaratne, Naveen Marapana, Sampath Zoysa and Ajith Jayathunga instructed by Priyantha Amunugama appeared for the petitioner Thilanga Sumathipala. |
