Udatalawinna Trial at Bar :

Grenade in deceased's right hand - Witness

by Sandasen Marasinghe

Army Sergeant Y. M. W. R. Upali Kiridena of the Bomb Disposal Squad (BDS) said that the grenade which was in the hand of a deceased was destroyed on the instructions of the former OIC of the Wattegama Police. He made this observation, yesterday, before the Trial-at-Bar hearing the Udatalawinna Massacre.

The Trial-at-Bar comprised High Court Judges Eric Basnayake (President), Deepali Wijesundra and Sunil Rajapakse.

The Log Book, in which the notes regarding the bombs were found inside the van on the scene, maintained by Army Sergeant Upali Kiridena was produced before the Court and seals were removed.

Examined by Deputy Solicitor General Palitha Fernando, Army Sergeant Upali Kiridena stated that six grenades of the 11 found in the van were foreign made used normally by the army.

Having referred to the Log Book, Kiridena said that the notes were made at 10.30 p.m. on December 5, 2001. Some of the grenades bore bullet marks. All the bombs were destroyed.

He said that he had defused more than 1000 bombs. He decided it was dangerous to keep the bombs and informed as such to the former Wattegama Police OIC Upali Nawalage. He said so under cross examination by Defence Counsel Tirantha Walaliyadda.

Questioned by High Court Judge Sunil Rajapakse, Kiridena stated that the bombs were destroyed on the instructions of Upali Nawalage. Only one or two of the grenades were in imminent danger of explosion but all the bombs were destroyed.

Deputy Solicitor General Palitha Fernando, Senior State Counsel Achala Wengappuli, Senior State Counsel Mohan Seneviratne and Senior State Counsel Shanil Kularatne appeared for Attorney General while R. I. Obeysekara PC, Tirantha Walaliyadda and Anil Silva appeared for the Defence.

Further hearing may resume today (16).
