News Business Features Editorial Security Politics World Letters Sports Obituaries | Case against Mangala dismissed with costs The defamation case filed by Minister Prof. Jayalath Jayawardena against former Minister Mangala Samaraweera was dismissed with costs by the Colombo Additional District Judge Mahinda Samayawardena when the case came up for hearing yesterday. Petitioner Prof. Jayalath Jayawardena was not present in court. Prof. Jayawardena had filed this case claiming Rs. 500 million as damages from Mr. Samaraweera for implicating his name in a so-called UNP-LTTE Secret Pact (Ali-Koti Givisuma) disclosed by Mr. Samaraweera during the last general election campaign. When the case was called lawyers representing Ferrel Ratnayake Associates which had filed the case moved for a date saying they could not find an Attorney-at-Law to appear for the petitioner. Attorney-at-Law Wijayadasa Rajapakse PC who appeared for the respondent Mangala Samaraweera said it is regrettable that the petitioner who was a responsible Minister and a Professor could not find a lawyer to appear for him. He said the respondent had valid evidence including a report from an examiner of questioned documents to prove that the document in question contained Prof. Jayawardena's own handwriting. Mr. Rajapakse said petitioner Prof. Jayawardene had deliberately kept away without attending courts because he was unable to face the truth and prayed that the case be dismissed. Court which upheld Mr. Rajapakse's arguments dismissed the case with costs. |
