Interim plea against appointment of Director, National Archives refused

The Supreme Court yesterday refused to grant the interim relief to stop making any appointments to the post of Director, National Archives until the final determination of the Fundamental Rights application filed by one of its assistant directors.

The court observed that in terms of the submissions made by the State Counsel, that it was not inclined to grant the interim order prayed for by the petitioner. State Counsel Rajiv Goonatilake informed Court that the sixth respondent, Mrs. Saroja Wettasinghe had been selected by the interview board for the post since she held post graduate qualifications from the University College of London as required by the scheme of recruitment.

The court fixed the case for hearing for June 28.

The Bench comprised Chief Justice Sarath N. Silva PC, and Justices Dr. (Mrs.) Shirani Bandaranayake, and Asoka de Silva.

The petitioner stated that the 1-5 respondents the members of the interview board had selected Mrs. Saroja Wettasinghe who did not have the prerequisites even to be called for the interview as the Director, National Archives over and above the petitioner who was the only qualified candidate.

He stated that there was an imminent infringement to the rights of the petitioner in case if the Cabinet approved the appointment of the sixth respondent.

He stated that the appointment of the sixth respondent as the Director would be a denial of his seniority and was in violation of his Fundamental Rights. Petitioner L.R. Gunawardane of Moratuwa cited the five member interview board, the Cabinet of Ministers, Mrs. Saroja Wettasinghe and the Attorney General as respondents.

Wijayadasa Rajapakse PC with I.M. Wijebandara appeared for the petitioner.

State Counsel Rajiv Goonatilake appeared for the respondents.

The hearing was fixed for June 28.
