by Sarath Malalasekera Inspector General of Police Indra de Silva said yesterday that the Army and Police personnel found guilty of acting unlawfully by the Presidential Commission in the Athurugiriya millennium city Army safe house raid face prosecution. The IGP told the Daily News he will consult the Attorney General before instituting legal proceedings against the offenders. He said a special police team headed by a senior police officer had been assigned to commence investigations based on the report released by the Presidential Secretariat. A comprehensive report on the police investigation will be submitted to the Attorney General for his advice before legal action is preferred against those responsible. The IGP had requested the Police Commission to send ASP Kulasiri Udugampola on compulsory leave until the completion of the investigations based on the report forwarded by the Presidential Secretariat in connection with the raid on the Army safe house. The Supreme Court recently held that ASP Udugampola had illegally arrested, detained and subjected the victims to inhuman and degrading treatment and treated them differently. The Supreme Court has given a comprehensive order in connection with the safe house fiasco. Therefore the Police Commission could act on his request to send ASP Udugampola on compulsory leave, as there is a tendency that the ASP would interfere with the witnesses, the IGP said. The Supreme Court ordered ASP Udugampola personally to pay Rs.250,000 to the five petitioners who filed fundamental rights applications for compensation. The IGP emphasised that if the ASP is found guilty under the normal laws of the land, he would be interdicted and action taken according to the law. Any person found guilty following the investigations would be prosecuted under the existing laws, the IGP added. |
