First accused sentenced to 3 years' R.I. Panadura group correspondent The first accused in the Piliyandala murder case was found guilty of committing a murder exceeding the right of self defence, by the Panadura Additional Provincial High Court Judge, Maxwell Paranagama. He was sentenced to three years' R.I. The second, third and the fourth accused were acquitted on all charges as the prosecution failed to prove the charges beyond reasonable doubt. The accused are A.M. Piyasiri Peiris, A.M. Neil Shantha Peiris, A.M. Gamini Piyatissa Peiris, and A.M. Damayanthi Peiris, all members of one family. In this case, the accused were indicted by the Attorney General with committing the murder of Gallage Shelton of Piliyandala on 25.05.1998 by assaulting him. Accused discharged were freed on the charges of aiding and abetting the first accused to commit the murder. The Judge delivering the Judgment in open court on Thursday, said every person enjoyed the right of self defence. But he must know how to act according to the law. Otherwise he or she had to face a court trial on charges of committing a murder. In this case the prosecution had not proved any of the charges against the other accused. But according to the evidence it is proved that the first accused A.M. Piyasiri Peiris had committed the murder of Shelton, exceeding the right to self defence. I find the first accused guilty of the charge, the Judge said. Jayaweera Bandara, Attorney-at-Law defended the accused instructed by Y.D. Tissera Attorney-at-Law. State Counsel Madawa Tennakoon prosecuted. |
