A guardian for Dr. Gamani Corea

Additional District Judge G. A. D. Ganepola appointed Dr. Lalith Kotelawela as Manager and Guardian of Dr. Gamani Corea.

Dr. Kotelawela filed an application in the District Court of Colombo to appoint himself as the Manager and the Guardian of Dr. Corea stating that Dr. Corea is a bachelor and 77 years and is suffering from dementia and Alzheimers type disease rendering him mentally ill, feeble, infirm or defective and he is unable to manage his own affairs and therefore to appoint the petitioner as the Manager and Guardian for his affairs.

When the case came up for inquiry Wijeyadasa Rajapakse PC who appeared on behalf of Dr. Corea informed Court that he is suffering from Dementia and Alzheimers type disease and Dr. Corea is not contesting the medical reports filed of record and therefore Dr. Kotelawela could be appointed as Dr. Corea's Manager and Guardian.

Dr. Corea's Counsel submitted to Court that Dr. Kotelawela is the only person who looked after Dr. Corea and the other interested parties who tried to intervene in this case with ulterior motive were not allowed by Court to intervene into this case.

The Petitioner's counsel informed Court that after serving the Order Nisi on the respondent to date no objections have been field to the Order Nisi by the respondent and furthermore as the Respondent's Counsel is not contesting the series of medical reports of Dr. Corea's submitted to Court, Court should appoint Dr. Kotelawela as Manager and Guardian of Dr. Kotelawela.

Counsel for Dr. Kotelawela further informed Court due to unwarranted allegations levelled against him through media and as he had no other vested interest in respect of Dr. Corea's wealth, he was compelled to make an application to Court to appoint him as Manager and Guardian to look after Dr. Corea.

Having heard the submissions made by both Counsel and having perused the petition, affidavit and the medical reports submitted by doctors in respect of Dr. Corea's physical condition and having been satisfied that Dr. Kotelawela is the fit and proper person to be appointed as the Manager and the Guardian of Dr. Corea, Court appointed Dr. Kotelawela as Manager and Guardian of Dr. Corea.

Attorneys-at-Law Kuvera de Soyza with Malin Rajapakshe, instructed by G. G. Arulpragasam Attorney-at-Law appeared for Dr. Kotelawela who is the original petitioner in this case.

Wijeyadasa Rajapakse with Kapila Liyanagamage, Attorney-at-Law instructed by Binara Gunasekera, Attorney-at-Law appeared for Dr. Corea.
