Letters of suspension of studentship withdrawn

The counsel for the Sri Jayewardanepura University yesterday informed the Supreme Court that the letters of suspension of studentship on four students could be withdrawn.

The court earlier granted time to Srinath Perera, counsel for the Jayawardanepura University Disciplinary Board to obtain instructions as to whether letters would be issued only terminating the suspension of studentship of four students, without convicting them for any charges, in line with the written submissions, tendered by it.

The Bench comprised Chief Justice Sarath N. Silva PC, Justices T. B. Weerasuriya and Mrs. Shirani Thilakawardane.

The court, earlier, observed that the judgement was reserved in the Fundamental Rights application filed by four students of the Sri Jayawardanepura University against the suspension of their studentship on September 28.

The written submission by the respondents filed in the court indicated that the suspension of studentship of 4 students had been terminated, and, which was the relief sought by the students in their application.

Petitioners S.J.M. Kumudu Nadeeka Taranganie of Kalugamuwa, Kurunegala, W.G.A. Chandrakanthi Siriwardane of Hanguranketa, H.P. Sanjeevani Sriyalatha of Thihagoda, Matara and Sugath Priyantha of Kuruvita cited Chancellor of the University of Jayawardanepura, its Vice Chancellor, eight members of the University Disciplinary Board and the Attorney General as respondents.

They claimed that they were discussing a problem in respect of the hostel during the lunch on February 2, when the warden of the hostel threatened and alleged them of holding an unauthorized meeting.

They alleged that they received letters suspending their studentship on March 24, signed by the second respondent.

Petitioners stated that the said suspension was illegal, ultra vires and contrary to the Interim Constitution of the University students. Wijedasa Rajapakse PC with Kuvera Ranasinghe appeared for petitioners. Srinath Perera PC appeared for respondents.
