TRC case against Mobitel dismissed

The court action filed by the Telecommunications Regulatory Commission (TRC), against Mobitel (Pvt) Ltd, for allegedly violating provisions of the Telecom Act, was withdrawn by the Attorney General's Department last week. The TRC filed criminal action in the magistrate's Court against Mobitel, subsequent to Mobitel requesting a stay order in the Court of Appeal against TRC's directive on November 19, 2003.

The directive prohibited the company from recruiting customers to test the system during the trial period to the mechanism of 11 minutes free outgoing and free incoming offer. This offer would allow further optimisation of the network, to ensure call drops and congestion to be minimised prior to the commercial launched on January 1, 2004.

The withdrawal by the Attorney General's Department is proven affirmation of Mobitel's right to offer customers unrestrained access and economic benefit to the opportunities brought about by EDGE technology and Caller Party Pays (CPP).

Mobitel's legal team was headed by Shilby Aziz P.C. with Kolitha Dharmawardena and Dr. Harsha Cabral assisting.

The company is committed to improving the lives of the public by continuing to offer its customers 11 benefits along with the EDGE GSM technology and other commercial benefits to customers who sign up on the network prior to December 31, 2003.
