Liquor outlet dispute settled A long-standing dispute over the management of a liquor outlet at the Sri Lanka Government Services Sports Society in Narahenpita was settled in court with the defendant withdrawing the counter claims against the Plaintiff and handing over the management of the liquor outlet to the Plaintiff Society. The case was heard before Colombo Additional District Judge S. W. Jayasooriya. The Plaintiff is the Sri Lanka Government Services Sports Society Ltd. of No.2/12, 2/16, Polhengoda Road, Narahenpita. The Defendant is Sandra Fonseka of No.24/1, Rodrigo Avenue, Galpoththa road, Nawala. In their plaint the Sports Society had stated that in spite of the fact that the lease in respect of the management of the liquor outlet had expired on 30th June 2002 the Defendant continued to manage the said liquor outlet. It asked Court for a declaration that the Defendant had no right to manage same and an order of ejectment and damages in a sum of Rs. one million five hundred and fifty five thousand. The Defendant in her answer had denied all the allegations contained in the plaint and also set up two counter claims , one in respect of frustration of the business activities in respect of the management of the liquor outlet and the other in respect of obtaining an enjoining order which restrained her trade for a considerable period. When the matter was taken up for trial, it was agreed to settle the entire dispute by withdrawing the counter claims against the Plaintiff Society by the Defendant and the Defendant vacating the premises handing over the management of the liquor outlet to the Plaintiff Society and Plaintiff waiving off the damages against the Defendant. Dr. Jayatissa De Costa with D.D.P.Dassanayake, Chintaka Siriwansa and Shana Mahfi appeared for the Plaintiff Society. Ranjan Suhandaratne with Ranjit D. Perera appeared for the Defendant. |
