by Wasantha Ramanayake The Supreme Court granted Leave to Proceed with a Fundamental Rights application filed by Matale District MP Janaka Bandara Tennakoon against several police personnel attached to the Dambulla Police Station. The Bench comprised Chief Justice Sarath N. Silva PC, and Justices H.S. Yapa and Asoka de Silva. Petitioner cited 14 respondents including HQI IP Sudath Asmadala, IP Samarasiri Kumara Crime OIC both of the Dambulla Police Station. Petitioner claimed that he organized a public meeting on August 3. Some of his supporters who were engaged in decorating the streets were assaulted by a gang that included one Habakkala. One of his supporters had complained the incident to the Dambulla Police. Petitioner alleged that the respondents had not investigated the matter. Petitioner further alleged that the said Habbakkala lodged a complain against him and several others. Respondent Police officers without informing the petitioner about the said complain had obtained a warrant and subsequently an order of Attachment of Property of the petitioner from the Dambulla Magistrate submitting false information. Petitioner stated that the said actions of the respondent Police officers were in violation of the petitioner's rights and sought a declaration to that effect and suitable compensation. Mohan Pieris with Nuwanthi Dias instructed by Chrisho Kumara Jayarathne appeared for petitioner. The hearing was fixed for December 15. |
