by Wasantha Ramanayake The Court of Appeal yesterday issued notice on the University Grants Commission (UGC) in nine writ applications filed by a group of Veterinary Science undergraduates seeking places in a Medical Faculty. The Bench comprised Justices N.K. Udalagama and Jagath Balapatabendi. Nine Petitioners including D.L.N. Dilrukshi Kularatne of Dehiwala in separate applications cited the UGC, its chairman, the members, the secretary to the UGC and the Attorney General as respondents. Counsel Dr. Jayatissa de Costa on behalf of the petitioners submitted that his clients sat for the GCE Advanced Level Examination in August 2001. In terms of their higher Z-score they had a legal expectation to gain admission to a medical faculty. However, they were offered places in the Faculty of Veterinary Science since the cut off mark for Medicine was higher than their Z-scores. The counsel further submitted that the UGC in terms of a Cabinet direction admitted a batch of 47 students to medical faculties lowering the cutoff mark that was lower than that of the petitioners. Therefore, the UGC should grant the petitioners places in a medical faculty. Dr. Jayatissa de Costa instructed by D.D.P. Dassanayake appeared on behalf of the petitioners. The notices were returnable on September 19. |
