Mundo gas allowed refilling of any trademark : SC restores interim order vacated by Court of Appeal till July 16

The Supreme Court yesterday restored the interim order restraining the Mundo gas Company from accepting empty Liquid Petroleum Gas (LPG) cylinders bearing any trademark for filling/refilling purposes, that was vacated by the Court of Appeal on June 24. The order would be valid up to July 16.

This was sequel to an application made by counsel for Petitioner-petitioner Shell Company.

The Bench comprised Chief Justice Sarath N. Silva PC, and Justice H. S. Yapa and Nihal Jayasinghe.

In this Special Leave Application, Petitioner-petitioner Shell Company cited the Consumer Affairs Authority, its Chairman R. I. Wimalasena, Laugfs Lanka Gas (Pvt) Ltd. and Mundo gas Lanka (Private) Ltd. as respondents-respondents.

Commerce and Consumer Affairs Minister Ravi Karunanayake was seen in the Court during the proceedings.

K. Kanag Iswaran PC with Chanaka de Silva, Nigel Bartholomeusz and Vijaya Gamage instructed by Sudath Perera Associates appeared for petitioners.

Gamini Marapana PC, Palitha Kumarasinghe and N. Marapana instructed by G. G. Arulpragasam appeared for first and second respondent.

Romesh de Silva PC with Hiran de Alwis instructed by DL and F de Saram appeared for third respondent.

S. L. Gunasekera instructed by Varners Lanka appeared for Mundo gas. Case was put off for July 16.
