Woman burnt due to negligence

Nawaloka Hospital sued for Rs. 10 million

A woman who sustained burn injuries whilst recuperating at the Nawaloka Hospital after a caesarean operation, has sued the hospital claiming a sum of Rs 10 million as damages.

The case came up before the Additional District Judge Ranil Dharmasekara. In this case, the plaintiff, Niranjala Vergin Fernando of Hendala has cited Nawaloka Hospitals (Pvt) Ltd as the sole respondent.

Fernando states that she was admitted to Nawaloka Hospital on May 24, 2002 for a caesarean operation. She claims that after anaesthetizing the lower part of the body, she was taken to another room. On gaining consciousness, she found her foot covered with hot-water bags. The plaintiff claims though she cried out, no one attended to her.

She claims that her legs were burnt as a result of the negligence on the part of the hospital staff and that later she came to know that those hot-water bags should have been removed within a short time from the operation.

The plaintiff also claims that she was discharged on May 30, 2002, from the hospital. Since then she had got treatment for these burn injuries on 20 occasions and five surgical operations were performed.

She further claims that these injuries were caused due to the non-removal of the hot-water bags at the stipulated time and that she was not attended to by any member of the hospital staff in spite of her repeated callings.

She urged the Court that the Hospital be ordered to pay her a sum of Rs 10 million as damages.

Further hearings were put off for August 1, 2003.
