by Wasantha Ramanayake The Attorney General would not appeare for the two jail guards who allegedly assaulted Michael Anthony Emmanuel Fernando, State Counsel K. A. P. Ranasinghe submitted before the Supreme Court, when the Fundamental Rights application filed on behalf of Emmanuel Fernando was taken for hearing, yesterday. The Bench comprised Justices Dr. (Mrs.) Shirani Bandaranayake, Asoka de Silva and C. N. Jayasinghe. Petitioner, Attorney-at-Law, Suranjith R. K. Hewamanne of Colombo 6 filed the application on behalf of Anthony Michael Emmanuel Fernando of Dehiwala, who was presently at Welikada Prison. Petitioner cited Gayan Chrishantha and W. A. Priyashantha, two jail guards of Welikada Prison, Commissioner General of Prisons, Secretary to the Ministry of Interior and Attorney General as respondents. Petitioner stated that Anthony was sentenced to one year's rigorous imprisonment for contempt of court and was taken to Welikada Prison on February 6. Petitioner alleged that first and second respondent jail guards had kicked Anthony on his stomach and spine inside the prison bus on the way back to Welikada Prison after being treated at the National Hospital on February 10. Desmond Fernando appeared for petitioner. State counsel K. P. A. Ranasinghe appeared for the Attorney General. The hearing was fixed for August 7. |
