by Kumar Wethasinghe and Indeewara Thilakaratne Film ideal Joe Abeyawickrama yesterday said before the Commercial High Court that he and his son Channa had initiated action when they were convinced that the respondents had acted in violation of their rights, when the Rs. 10 million damage suit filed by Joe and as his son Channa against Torana Video Movies in connection with the Copyrights of "Saki Sada Eliyas" came up before Commercial High Court Judge K.T. Chitrasiri. Accordingly Judge K.T. Chithrasiri issued an enjoining order restraining Torana Video Movies Pvt Ltd from reproducing, selling of Video copies of the Teledrama "Sakisada Eliyas" produced by veteran actor Joe Abeyawickrama till March 27, 2003. In this case, the plaintiffs Joe Abeyawickrama and his son Channa have cited Torana Video Movies Pvt Ltd and its CEO Sarath Kotalawala as respondents. The plaintiff Joe Abeyawickrama testifying stated that the teledrama "Sakisada Eliyas" which has been telecast over Sri Lanka Rupavahini channel, had been copied and reproduced and sold in video cassettes by the respondents. Joe further said that on hearing of the illegal reproduction of his teledrama, he sent an agent to the respondents sales point and purchased two of the VCDs. While watching the VCD he had noticed the Rupavahini Logo and confirmed that it has been illegally produced. The plaintiff further submitted that he had bought a video cassette and lodged a complaint with the Bribery Commission. He said that is the said cassette and receipt in police possession. Having heard the submissions made by the plaintiff, the presiding judge stated that the defendants had violated Section 6 of Intellectual Property Act and issued an enjoining order till March 27, 2003. Kuwera de Zoysa with Vijitha Perera appeared for the plaintiff. |
