by Indeewara Thilakarathne The Supreme Court granted leave to proceed with the Fundamental Rights Plea filed by the Information Technology Consultant Dilantha Vithanage challenging the arbitrary interdiction of him by the Secretary to the Human Resources, Education and Cultural Ministry. The Bench comprised Justices Mark Fernando PC, D. P. S. Gunasekara and C. V. Wigneshwaran. The petitioner has cited Human Resources, Education and Cultural Ministry Secretary V. K. Nanayakkara and the AG as respondants. The petitioner states that he holds a Masters Degree in Computer Science from the Technical University of Georgia and is currently working as the Information Technology Consultant in the Ministry of Education. The petitioner also states that his service was terminated by the circular dated 30.08.2002. He claims that the Secretary has no legal provisions to terminate his service as he was appointed by the Cabinet. Therefore the petitioner pleads the Court to declare that his Fundamental Rights were violated by this action. He also urged to declare the illegal termination of his service as null and void and to grant further reliefs. |
