Mangala - GL case: Kitulgoda's name taken out as respondent

The Court of Appeal yesterday allowed an application to amend the caption in the Writ Application filed by PA MP and Chief Opposition Whip Mangala Samaraweera seeking a Writ of Quo Warranto.

This application is for the disqualification of the Enterprise Development, Industrial Policy and Investment Promotion Minister G. L. Peiris as a Member of Parliament.

The Bench comprised Justices Nihal Jayasinghe and K. Sripavan.

Petitioner's Counsel moved to amend the caption to remove the name of Dhammika Kitulgoda as the Secretary General of Parliament.

Samaraweera has cited G. L. Peiris, UNP General Secretary Senarath Kapukotuwa, Dammika Kitulgoda, Secretary General of Parliament, Elections Commissioner Dayananda Dissanayake and the Attorney General as respondents.

Samaraweera alleged that the first respondent Minister G. L. Peiris was receiving benefits from a land alienated to the Peiris by the Land Reform Commission. He alleged that Minister Peiris was guilty of having such interest and getting benefits, in terms of the Article 91 (1) (e) of the Consitution.

The Court also granted time to file objections till October 9.

Wijayadasa Rajapakse PC with Kapila Liyanagamage appeared for the petitioner.

Romesh de Silva PC with Maithree Wickremesinghe instructed by Sudath Perera Associates appeared for the respondents.

The case was put off for October 9.
